Right of withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day on which you or a third party named by you, who is not the carrier, took possession of the goods. In the case of an order for several goods within a single order that are delivered separately, the period begins on taking possession of the last item.

To exercise your right of withdrawal, you must inform us,

by means of a clear statement (for example a letter sent by post or an email) of your decision to withdraw from this contract. You may use the attached model withdrawal form for this purpose, although it is not mandatory.

To meet the withdrawal deadline, it is sufficient that you send your communication concerning the exercise of the right of withdrawal before the withdrawal period has expired.

Consequences of withdrawal

If you withdraw from this contract, we will reimburse you all payments received from you, including delivery costs (with the exception of the additional costs resulting from your choice of a type of delivery other than the least expensive standard delivery offered by us), without undue delay and no later than fourteen days from the day on which we received your communication of withdrawal from this contract.

For this reimbursement we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; in no case will you be charged any fees for this reimbursement. We may withhold the reimbursement until we have received the goods back or until you have provided proof that you have sent back the goods, whichever is the earlier.

You must return or hand over the goods to the address stated above without undue delay and in any case no later than fourteen days from the day on which you notify us of your withdrawal from this contract. The deadline is met if you send the goods before the period of fourteen days has expired.

You bear the direct cost of returning the goods.

You are only liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

Exclusion of the right of withdrawal for food

Important note: The right of withdrawal does not apply to contracts for the supply of sealed goods which are not suitable for return for reasons of health protection or hygiene if their seal has been removed after delivery.

Since the organic energy gels we sell are sealed food products, your right of withdrawal is excluded for reasons of health protection and hygiene as soon as the original packaging (the sachet or the outer packaging of the sales unit) has been opened, damaged or the seal has been removed.

This exclusion is based on:

• Section 312g (2) no. 3 BGB (Germany)
• Section 18 (1) no. 5 FAGG (Austria)
• Art. 59 lett. e Legislative Decree 206/2005 Consumer Code (Italy)
• Art. 40h OR in conjunction with the exemption provisions (Switzerland)

As long as the sales packaging is unopened and undamaged, you can exercise your right of withdrawal within the fourteen day period without restriction.
