General Terms and Conditions

Note: the German version of these terms and conditions is legally binding. This English translation is provided for information purposes only.
These general terms and conditions (hereinafter "GTC") apply to all orders placed by consumers within the meaning of the Italian Codice del Consumo (Legislative Decree 206/2005), Section 13 of the German Civil Code (BGB), Section 1 of the Austrian Consumer Protection Act (KSchG) and the Swiss Code of Obligations (OR) via the online shop at sapple.com with Sapple GmbH.
1. Seller and contracting party

2. Scope
These GTC apply exclusively to consumers with a delivery address in Germany, Austria, Italy or Switzerland. Deviating terms of the customer are not recognised unless Sapple GmbH expressly agrees to their validity in writing.
3. Subject matter of the contract
The subject matter of the contract is the sale of food products, in particular the organic energy gel Sapple based on organic apples from our own cultivation. The respective product description in the online shop and the label on the packaging are decisive for the product characteristics.
4. Conclusion of the contract
The presentation of products in the online shop does not constitute a legally binding offer but an invitation to order. By clicking the button "Order with obligation to pay" the customer submits a binding offer to conclude a purchase contract. An automated order receipt confirmation by email does not yet constitute acceptance. The contract is only concluded upon express order confirmation or, at the latest, upon dispatch of the goods.
The contract text is stored and cannot be retrieved directly by the customer after completion of the order. Order information is sent by email.
5. Prices and shipping costs
All prices are in euros and include the Italian statutory VAT of 22%. Shipping costs are shown separately and amount to a flat rate of €10 for deliveries to Germany, Austria and Italy and €20 for deliveries to Switzerland.
For deliveries to Switzerland, additional import duties, customs charges and VAT may apply, which are borne by the customer. The applicable regulations of the Swiss Federal Customs Administration apply.
6. Payment
Payment is made, at the customer's choice, by credit card (Visa, Mastercard, American Express via Stripe), PayPal or advance payment by bank transfer. In the case of bank transfer, the goods are dispatched once the full purchase price has been received in our account. Detailed payment information is available under "Payment methods".
7. Delivery and delivery time
Delivery is made to the delivery address specified by the customer via our standard carrier. The delivery time is usually 3 to 5 business days for deliveries to Germany, Austria and Italy and 5 to 7 business days for deliveries to Switzerland, in each case from the dispatch date. In the case of bank transfer, the delivery time starts on the day the payment is received. Further details under "Shipping information".
Since the products sold are food, Sapple GmbH reserves the right to postpone delivery at short notice in extreme weather conditions to protect product quality.
8. Retention of title
The delivered goods remain the property of Sapple GmbH until the purchase price has been paid in full.
9. Right of withdrawal
Consumers are in principle entitled to a statutory right of withdrawal. The detailed withdrawal policy and the model withdrawal form are available under "Withdrawal".
For reasons of health protection and hygiene, the right of withdrawal does not apply to deliveries of sealed food products whose seal (original packaging) has been removed after delivery (Section 312g(2) no. 3 BGB, Art. 59(e) Codice del Consumo, Art. 40h OR).
10. Warranty and liability for defects
The statutory warranty rights for defects apply. For food products, the warranty is based in particular on the best before or use by date stated on the packaging. Obvious transport damage should, if possible, be reported to the courier immediately and communicated to Sapple GmbH. Failure to make this complaint has no consequences for statutory warranty claims, but helps to enforce claims against the carrier.
11. Liability
Sapple GmbH is liable without limitation for intent and gross negligence as well as under the provisions of product liability law. For slight negligence, Sapple GmbH is only liable in the event of a breach of an essential contractual obligation (cardinal obligation) and for damages resulting from injury to life, body or health. In the event of a slightly negligent breach of a cardinal obligation, liability is limited to the foreseeable damage typical of the contract.
12. Food product information
All mandatory information pursuant to Regulation (EU) No 1169/2011 (Food Information Regulation), in particular the list of ingredients, allergen information, nutrition declaration, best before date and net quantity, is provided in the respective product description and on the packaging.
13. Dispute resolution
The European Commission provides a platform for online dispute resolution (ODR platform): https://ec.europa.eu/consumers/odr. Sapple GmbH is neither obliged nor in principle willing to participate in dispute resolution proceedings before a consumer arbitration board.
14. Applicable law and jurisdiction
Italian law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). For consumers habitually resident in the EU, the mandatory consumer protection provisions of their country of residence remain unaffected. The place of jurisdiction, insofar as legally permissible, is the registered office of Sapple GmbH in Bolzano, Italy.
15. Severability clause
Should individual provisions of these GTC be or become invalid, the validity of the remaining provisions remains unaffected. The invalid provision is replaced by the statutory provision.
